SC refuses to stay Mhada allotments

The Supreme Court on Thursday refused to pass an interim order staying the allotment of 3,863 tenements to the successful winners of the lottery scheme of the Maharashtra Housing and Area Development Authority (Mhada).

The ruling came on a special leave petition (SLP) filed by Gaya Singh Yadav, challenging the Bombay high court's order of October 15, lifting the stay on giving possession of the flats to the lottery winners.

Counsel for the petitioner cited a report of the comptroller and auditor-general (CAG) on previous allotments in 2005-06, which suggested that the lottery software was defective and the grant of possession of the tenements should be stayed till the SLP was disposed of.

But the apex court refused to grant any interim order staying the allotments. On October 6, a division bench of justice JN Patel and justice RP Sondur-Baldota in the Bombay high court had stayed the allotment of flats to successful applicants.

But the stay was lifted on October 15 after Mhada's chief executive officer filed an affidavit assuring the court about physical scrutiny of every single application by its officers.Senior advocate MukulRohatgi appeared on behalfof Mhada.
