SC allows Bar Council to publish results of exams

A lawyer had challenged BCI’s jurisdiction to conduct open book examination for law graduates.

In a major relief to thousands of aspiring lawyers in the state, the Supreme Court has allowed the Bar Council of India (BCI) to announce the results of the qualifying examinations conducted for law graduates before allowing them to practise as lawyers. 

A Kolkata-based lawyer had challenged the jurisdiction of the BCI to conduct the open book examination for law graduates, before issuing them the sanad to practise in courts, in the Calcutta high court (HC). 

The HC had stayed the BCI from announcing the results of the qualifying examination. 

The BCI had challenged the stay order in the Supreme Court, following which the SC revoked the ban. 

Dr Mukund Sarda, dean and principal of New Law College, told DNA, “It is good that the Bar Council of India is taking the examination to improve the quality of lawyers. It is an open book examination and most of the students clear it. Such examinations are conducted in the US and other European countries.” 

However, a section of the legal fraternity had a different opinion on the issue. 

Saipan Shaikh (25), a student of YC College, told DNA, “I cleared my examination in hard times, as I cannot practise in court despite having a degree in law. In December, I gave my Bar examination and waited for my results. Now, I am working more like a clerk with a senior lawyer, working day and night and not getting enough money.” 

Advocate Milind Pawar  told DNA, “When students take up law courses, all colleges must conduct an entrance examination for both courses. The examination conducted by the BCI after graduation is not worth it, as the aspiring lawyers have to wait for another six months to get their sanad from the BCI.”
