The Bombay high court on Friday rejected a case filed by the residents of two Netaji Nagar buildings, which were the only hindrance in the completion of the Mumbai Metropolitan Region Development Authority’s (MMRDA) most delayed project, the Santa Cruz-Chembur Link Road (SCLR).
The residents were asking for resettlement on par with that of Tilak Nagar flat owners, who had been granted tenements with an area of 480sq ft. The high court instead granted them a carpet area of 450sq ft for their resettlement at Bharat Nagar, Bandra-Kurla Complex, Bandra (E).
Three affected Netaji nagar buildings had moved court seeking similar settlement as the Tilak nagar one. However, the High Court today accepted the affidavit-in-reply submitted by MMRDA, and allowed the resettlement of only two of them.
The MMRDA will now have to resettle the 64 flat owners of the two buildings at Bharat Nagar at the BKC. The two buildings have to be constructed by Housing Development Infrastructure ltd (HDIL) within 36 months.
The MMRDA will offer, in advance, monthly compensation or rent of Rs10,000 to each of the 64 residents for a period of 30 months, or till the buildings are ready for possession. Alternatively, the MMRDA has also offered temporary accommodation to these flat owners at five different sites, like Motilal Nagar (BKC), Bhakti Park (Wadala), Bhandup (W), Kanjurmarg and Oshiwara.
The flat owners have to hand over possession to the MMRDA within thirty days of signing the MoU. The MMRDA expects to complete all formalities within a period of three weeks.
