The Bombay high court on Wednesday asked the commissioner of police to reply to a petition based on conspiracy theories regarding the death of former anti-terrorism squad chief Hemant Karkare during the 26/11 Mumbai terror attacks.

The division bench of justices BH Marlapalle and UD Salvi were hearing two petitions, including one filed by Radhakant Yadav, a former MLA from Bihar, stating that Hindu extremists killed Karkare. His petition contends that Hindu right-wing organisation Abhinav Bharat, accused of plotting the Malegaon blasts, was behind Karkare’s death.

His petition also refers to a book written by former inspector general of police SM Mushrif, titled Who killed Karkare?, which has taken a similar view. Yadav urged for a direction for a special team to probe this angle.

Additional solicitor general Darius Kambata said, “If there was such an angle, it would have been found,” he said.

The judges said they do not want to admit the petition and keep it pending. “Mushrif need not come before us. Let somebody from Mumbai Police make a statement,” said justice Marlapalle.

When petitioners’ lawyer Amit Sale pointed to a paragraph about information by the intelligence bureau, which was not passed to Mumbai police, justice Marlapalle retorted, “In other words, you are telling us to buy the book. We will be able to read it in the vacations.” The case has been adjourned by four weeks.
