“We will be inspecting nursing homes that do not have separate access. If the nursing homes are not a nuisance, a no-objection certificate will be issued within 15 days,” said Dr GT Ambe, an executive health officer. The Brihanmumbai Municipal Corporation (BMC) will issue a circular for 'change of user' in 15 days that will explain the procedure to be followed by nursing homes. The circular will mention the premium and penalty amount to regularise the structures.
“We never had issues with ‘change in user’ norm but the procedure was tedious and we had asked the BMC to help us. Now that the BMC has assured us to look after the matter, we have decided to call off the strike. However if nothing works out in next 15 days, we will go for strike,” said Dr Rajeev Walavalkar, a president of Association of Medical Consultants.
Most nursing homes in Mumbai are in residential buildings, and do not have separate entry/exit ways as required by the law. On July 30, 2010, the state issued a government resolution permitting nursing homes, even those without separate staircases, to operate on the condition that they have a ‘change of user’ certificate.
The BMC renews the registration after it verifies that residents are not affected. The deadline for the renewal is March 31, 2011, and will affect more than 1,000 nursing homes. The nursing homes had decided to strike after the BMC refused to renew licences.
