No Waqf breather for Mahim trust

The Waqf board has ruled that Kalyan dargah of Hazrat Shaikh Ahmed Fakih Paru belongs to the Ahle-Hadees sect and not the Bareli sect which runs it.

The Barelies were also restrained from performing Urs at Peerachi dargah, which according to historians, is where Hazarat Shaikh Ahmed Shah Fakih Paru was buried. The Sufi saint is said to be the father of Hazarat Makhdoom Ali Faikih Mahimi, who has a tomb at Mahim.

In an order passed on Tuesday, chief executive officer of the Waqf board ND Pathan noted that there is no relation between Pir Maqdum Saheb Charitable Trust, Mahim and the Kot Bahar Masjid Trust, who is presently the custodian of the dargah.

“If at all the devotees want to offer fateha and durud they may do so but not in groups. They may offer fateha on individual basis without disturbing the peace in the area,” the Waqf board stated.

The two sects had moved the Bombay high court, which recently directed them to make representations before the Waqf board. The petition was filed by Madeena Shaikh, who is a member of the Pir Makhdum Sahib Charitable Trust.

Petition states that the 644-year-old dargah used to be run and managed by the Mahim Dargah Trust. In 1944, the trust gave the caretaking responsibility of the dargah to one Ghulam Gous Mohiddin Jalal.

His family members who later adopted the Ahle-Hadees Sect, which does not believe in other rituals like fatiha (remembrance meet), locked the door of the dargah thus denying the followers of the Peerachi Dargah to worship its saint.

The petition said it had approached the Waqf board earlier to seek permission for holding the Urs between May 28 and 31, but the Urs plan was dropped after the Thane police commissioner refused to provide police protection.

The Waqf board order was submitted to the bench of Justices BH Marlapalle and UD Salvi, which has directed advocate Mubin Solkar appearing for the Kot Bahara Trust to inform the petitioners and adjourned the hearing till Thursday.
