Batting for sports activities at Shivaji Park in Dadar, the Bombay high court, on Thursday, denied permission to Raj Thackeray-led Maharashtra Navnirman Sena (MNS) to conduct the Marathi Food Festival on the open ground from May 3 to 10.

A division bench of chief justice Mohit Shah and justice Nitin Jamdar rejected the application for the festival observing that if permission was granted for the food festival then the open ground would not be available for sports activities.

The court was hearing an application filed by MNS to hold the eight-day festival there as a part of Maharashtra Day celebrations.
The party had approached the court after the Brihanmumbai Municipal Corporation (BMC) refused permission to hold the food festival there as it is silence zone. In pursuant to the 2005 high court order, following a petition filed by NGO Wecom Trust, the BMC had declared Shivaji Park as a silence zone, where use of loudspeakers is prohibited.

The BMC and Wecom Trust had opposed the MNS application stating the food festival would create nuisance and damage the ground. “If permission is granted to one political party then it would open a floodgate of such applications by other parties.

Food is not permitted inside the ground then how can permission be given to cook food there,” argued Wecom’s advocate.
Earlier in February, the high court had refused to grant permission to MNS to hold a public meeting at Shivaji Park.
