Even as the state government is conducting an inquiry into illegal constructions made in 21 high-rises along Navi Mumbai’s posh Palm Beach road, the developers are tense over an old adjustment  that may return to haunt them.

At the root of the illegality is the misuse of FSI from neighbouring plots that fall under the high-tension power cables passing through Sanpada.

When the builders of the 21 buildings began development of their projects, they ‘adopted’ the land under the power cables and merged it with their plots.

“First, Cidco has no right to sell the land under the power cables. The developers not only grabbed public space, but also used FSI from these plots to build extra floors,” revealed a leading Navi Mumbai developer.

On their part, the developers maintain that the issue is being blown out of proportion.

“There are no major illegalities, at best some minor oversights, for which we are willing to cooperate with the authorities and take necessary corrective measures,” said Bhupendra Shah of Bhumiraj Group, whose buildings are also under the scanner.

The issue flared up in 2007 when Sudam Hiwarkar, a local corporator, filed a PIL against Cidco and 13 builders challenging the allotment below high-tension wires at low prices.

In response, the developers proved that they had not only purchased the land at tender rate, but also paid a premium and compound interest for some period.

The high court dismissed the petition and asked Hiwarkar to pay a compensation of Rs1 lakh to each developer.
