The special court hearing the 26/11 attack case on Thursday asked the prosecution why the police had not examined independent witnesses present at the spot when Pakistani gunman Mohammed Ajmal Amir Kasab was nabbed at Girgaum Chowpatty.

Special public prosecutor Ujjwal Nikam replied that few people were present on the streets at the time of the attacks. “There were more common people on the road as compared to policemen,” judge ML Tahaliyani said.

The judge also pointed out that as per Kasab’s confession, he had shot at a policeman holding a rifle (referring to slain assistant sub-inspector Tukaram Ombale) but there is no evidence to show that Ombale was armed.

Nikam, however, urged the judge to look at the cumulative evidence on record while considering this point.

The court has also ordered the crime branch to dispose off the RDX seized by the police from various sites during the terror attacks.
