Two former navy men have moved the Bombay high court seeking inclusion of their four-year training period as their years of service to avail retirement benefits. The court’s decision in the case may affect the entire armed forces and may perhaps stretch over to other government jobs as well.

The petitioners in the case are Natrajan Venkateshwaran, 39, and Vinay Khattar, 39, both residents of Mumbai who accepted premature retirement from the post of naval commanders in 2008. Claiming retirement benefits under the Navy Act, 1957 and Navy (pension) regulations, 1964, the ex-naval officers moved court after the Indian Navy granted them no retirement benefits, available after 20 years of service.

Both the former officers have stated that they had undergone training in the navy from 1987 to 1991 in the 10+2 cadet entry scheme. They were posted on INS Mandovi in the training academy at Goa when they were inducted in the training programme. At the beginning of the programme, the petition filed by Venkateshwaran and Khattar states, they were also administered the oath of allegiance which was in effect till they finished training in 1991 and were permanently commissioned in the Indian Navy.

After serving in the navy till they attained the post of naval commander, Venkateshwaran was allowed premature retirement on March 31, 2008, and Khattar on October 31, 2008. When the two did not receive their retirement benefits, gratuity and other service benefits, they sent their advocates’ notice to the chief of naval staff on November 20, 2009. They, however, received neither a reply to the notice nor any of their claimed benefits. They were, therefore, compelled to move court. The court is likely to hear the case on February 18.
