Mumbai: The Bombay High Court has granted bail to one of the accused in TISS student's rape case.
The victim, a US citizen who was studying at city-based Tata Institute of Social Sciences (TISS), was allegedly gang-raped at the house of Kundan Raj Borghohain in April this year.
Six persons were arrested in this connection. However, High Court yesterday granted bail of Rs 50,000 to Kundan, saying that he did not seem to have participated in the crime.
Kundan, an engineering student, is the first to get bail in this case.
Prosecution's case is that the victim girl was taken to Kundan's flat in suburban Andheri, and raped. However, Kundan's lawyer argued that he merely welcomed them when they arrived, and was never in the room where the offence took place.
Agreeing with this contention, Justice AP Deshpande held that "it prima facie appears that the Kundan has not participated in the commission of the crime and that he left the place of crime (possibly the bedroom) after he switched on the music".
While granting bail to Kundan, judge directed him to report at Trombay police station once a week till the conclusion of the trial.
