The Bombay high court on Monday ordered the release of a 22-year-old former bar dancer from a shelter home so that she can marry her boyfriend whom she had met while working at a bar at Kurla.

The girl, who hails from Rajasthan, alleged in her petition that her parents had forced her into flesh trade and made her work at dance bars to support the family. During her stint as a dancer at a bar at Kurla in 2008, she met a man and the friendship soon blossomed into love. When the two decided to get married last year, the girl found that she did not have her age-proof documents.

They then decided to move in together. Accordingly, the girl left her parents’ house at Ghatkopar, and moved in with her boyfriend at Malad in March this year.

Miffed with her decision, the girl’s bother lodged a missing person complaint with the Bangu Nagar police station on March 3. The police apprehended her two days later, but found themselves against a wall when claims flew thick and fast over her age. To clear the air on the issue, they sent her to a hospital at Naigaum to determine her age.

The medical report proved that the girl is a major, but since she had filed an affidavit with the police refusing to return to her paternal home, she was sent her to a women’ shelter at Kandivli.

Soon after, the girl’s friend filed an affidavit before the police requesting that she be released into his custody. But, the girl filed a habeas corpus petition seeking that she be produced before the high court, where she would be granted her choice of stay.

Accordingly, on Monday, she produced before the court, where she said she wanted to marry her boyfriend, even as she alleged that she did not want to stay with her family, as they had tortured her, forced her to dance at bars and took away all her earnings.

A division bench comprising justice VM Kanade and justice PD Kode, after hearing the girl’s petition and after going through her medical reports, ordered her release from the shelter and allowed her to marry as per her will.
