Go for out of court settlement: Bombay High Court to Mafatlals

A division bench of Justice VM Kanade and Justice Abhay Thipsay suggested an out of court settlement to the counsels of Sheetal and the Mafatlal family members.

The hearing on litigations between industrialist Atulya Mafatlal and his estranged wife Sheetal is likely to continue for a while as the  industrialist is undergoing treatment for cancer in London. He is unlikely to return to Mumbai soon.

A division bench of Justice VM Kanade and Justice Abhay Thipsay suggested an out of court settlement to the counsels of Sheetal and the Mafatlal family members.

The court was hearing petitions filed by Atulya's daughter Marushka and sister Kunti Shah seeking quashing of the complaint lodged against them by Sheetal with the Gamdevi police station.

Sayaji Nangre, counsel for Marushka, said that settlement was not possible at this stage since Atulya is in London.

Zulfi Memon of MZM Legal, counsel for Sheetal said Atulya’s return to Mumbai was essential for the settlement.

Sheetal had lodged a complaint with the Gamdevi police against Atulya, his daughter Marushka, his siblings, his mother Madhuri and even his first wife Payal for causing physical and mental abuse.

“This cruelty complaint is only filed as retaliation to the theft complaint filed by step-daughter (Marushka) against Sheetal. Initially, Sheetal had filed complaint only against Atulya, mother-in-law (Madhuri) and brother-in-law (Ajay).  The names of Marushka and sisters were added later,” added Nangre.

Marushka, Atulya’s teenage daughter from first wife Payal who is studying in London, had filed the theft complaint on behalf of Atulya. She had alleged that Sheetal had stolen 40 paintings from the Mafatlal bungalow at Altamont Road.

Sayaji said because of the false implication in the cruelty complaint Marushka is required to take permission from the local court before travelling abroad.

Meanwhile, the Sessions Court granted permission to Marushka to visit London to complete her admission formalities for 15 days. Judge Swapna Joshi partly allowed Marushka’s application to visit London.

Marushka had sought permission to go for two years for completing her studies However, court allowed her to leave on September 27 and return by October 15.
