‘Frame-up’ nipped in the bud

Andheri SRA scheme promoter files complaint against developer, police claim it to be false

MUMBAI: After it emerged that builder Rajendra Chaturvedi had been framed up in an attempt to murder case, the Mumbai police have become extra cautious while handling such cases. In fact, this apparently has helped them prevent another such frame-up. 

Police sources said builder Divakar Shetty of Sagar Developers was booked by the Andheri police on the charge of cheating, after a complaint was filed against him by the promoter of a Slum Rehabilitation Authority (SRA) scheme in Andheri.

But investigations revealed that the allegation was not true; hence, a case has now been initiated against the complainant for lodging a false complaint.

The police said that Pradeep Ghadigaonkar, chief promoter of the scheme in Andheri (East), had filed the case against Divakar and Dinesh Punia of Salasar Dwellers Pvt Ltd. The Andheri police booked Divakar under various sections of IPC for cheating and common criminal intention on November 8 last year.

Divakar said Sagar Developers had three projects in Andheri (E) and one of them was the SRA redevelopment project. He had four partners in the project. “The main brains behind the case are two of my ex-partners Gangadhar Shetty and Kushal Dharod, and Sunil Tawri, who was removed from my company a couple of months back,” Divakar said.

Sagar Developers had sold the development rights of saleable property to Salasar Dwellers Pvt Ltd. Divakar’s partners, including Gangadhar and Dharod, had signed the agreement. But on May 14, 2007, Gangadhar and Dharod dissolved the partnership with Sagar Developers. They were given Rs7crore as per their demand. “A few months later, when the property prices went up, Gangadhar, Dharod and Ghadigaonkar asked me to cough up Rs7crore more. When I refused, they threatened that they would register a police complaint against me,” Divakar alleged.

A case was then registered against him with the Andheri police station,  Divakar said. “I was never called by the police for questioning. I was afraid that I would get caught in a framed up case, just like Rajendra Chaturvedi. The police authorities were in the process of issuing an arrest warrant against me. But KMM Prasanna, Zone 10 deputy commissioner of police (DCP), stalled the warrant, sensing some mala fide intentions on the part of Pradeep Ghadigaonkar,” he said.

The matter was investigated by Prasanna, who then appointed inspector RC Patil as the investigation officer. Patil sought statements of the 200 tenants and the committee members of the SRA scheme. A report was sought from the SRA officials, architect and other legal experts. “After the probe, we found the allegations levelled against Divakar to be false,” said DCP Prasanna.

“We believe that Ghadigaonkar had filed the case for some monetary gain,” Patil said. Ghadigaonkar said, “I have all the documents relating to the case, which will prove that my complaint was not false. I have already approached police officials regarding the case.”
