Cops book Shiv Sena rally organisers under environment act

The organisers of Shiv Sena’s dussehra rally may be in bigger trouble this time, as following the reports of high decibel levels at the rally venue sent by anti-noise activist Sumeira Abdulali, the Mumbai Police have registered the case also under the Environment Protection (EP) Act, against the organisers.

“I had sent my reports to the commissioner of police via e-mail. It was forwarded to the deputy commissioner of police (zone V) Aswathi Dorje. She has replied to me saying, the report has been included, along with a detailed report and complaint received from an officer of Shivaji Park police station, in her complaint regarding the breach of the prescribed noise levels mentioned in the schedule given under the Noise Pollution Control rules, 2000,” said Abdulali of Awaaz foundation, a non-governmental organisation working against noise pollution.

The Shivaji Park police station on Monday had registered the case under Bombay Police Act against the rally organisers. The activists had demanded that the case should also be registered under the EP Act, which mandate a penalty of up to Rs1 lakh and five years imprisonment.

“The authority to file a complaint under the EP Act is only for offices of DCP and above. As per the rules, I have made my complaint which has been registered under the EP Act. We will be presenting our case in front of the magistrate in Bhoiwada court on Wednesday morning,” said Dorje.

The Bombay high court had declared the Shivaji Park area as a silence zone. The high court had permitted the Sena to hold its rally on the condition of not exceeding the noise level above 50db.

But investigations carried out by the anti-noise activists revealed that the noise levels at the rally venue were between 85db and 90db.
