Child won’t lie about mother’s killers: Bombay high court

A child who witnessed her mother’s killing will not point fingers at innocents, the Bombay high court observed on Friday, while upholding the conviction and life sentence handed out to three men who killed a money-lender.

Pravin Wadkar, Maruti Pawar and Dilip Wadkar were in 2002 held guilty by a trial court for the murder of Sheela Awate, who had lent them Rs40,000. Awate was stabbed to death with a gupti (a sharp weapon) on December 21, 2001, and her school-going daughter Deepali witnessed the incident.

In their appeal before the high court, among other grounds, the trio had claimed that Deepali had not been able to identify them, and that her supplementary statement was recorded on the basis of photographs. The prosecution had not conducted an identification parade, which had weakened the case.

However, justice Ranjana Desai and justice VK Tahilramani observed, “She is an innocent girl, who is unlikely to accuse innocent persons of the murder of her mother. Her evidence is consistent and inspires confidence.”
