Can the Mumbai police commissioner revoke an arms licence issued in Uttar Pradesh by a competent authority?

A scrap dealer from Kurla, who is from UP but has been residing in the city for over a decade, claims his life is at risk without the weapon which was seized by the police after revocation.

Abdul Majeed Shaikh, in his petition moved before the division bench said that in 2005 he got for an arms licence in UP. In 2006, he went to register at the arms and ammunition branch. They issued a show cause notice to them and acting on the report submitted by the Kurla police, the licence was revoked.

Shaikh approached the appellate authority which also ruled against him thus he moved the high court. The petition states that the Mumbai police has committed a contempt of the district magistrate of UP, by passing an order contrary to it and has sought to set it aside.

However, public prosecutor PA Pol said, “If the authority has the power to grant licence then the Mumbai police also can revoke it. As per the police report, Shaikh got the licence using false documents.”

The bench though directed the state to provide its judgments holding that licence issued at one state can be cancelled at another.
