Brainvisa case: Court partly rejects discharge plea

The judicial magistrate (first class) PK Deshpande partly rejected the applications filed by accused Asma Sandip Thorwe (33) and Nilesh Suryakant Jangam for their alleged involvement in stealing the source code and duping a software company to the tune of Rs47.5 crore. The duo had sought discharge in the case.

According to the prosecution, Thorwe and Jangam, along with three other accused Samir Ashok Inamdar (38), Deepali Amol Inamdar (34) and Sunitkumar Srivastav (36), who were directors and office-bearers of Enthuse Technologies Pvt Ltd, duped an IT company, Brainvisa Technologies Pvt Ltd, having its registered office on Senapati Bapat Road and in New Jersey in the US, to the tune of Rs47.5 crore annually by illegally using the latter firm’s data code, from August 2006 to November 2008.

All the five accused are being prosecuted for the offence under section 406, 420 to read with 34 of the Indian Penal Code (1860) and section 65, 66 of the Information Technology Act (2000) and section 63, 63 (B) of the Indian Copyright Act (1957).

Chief operating officer of Brainvisa Technologies Pvt Ltd, Nitin Hemchandra Agarwal, registered a police complaint with the Chatuhshrungi police. The complainant came across a website
www.enthuselearning.com and noticed a demo car engine technical insight similar to the demo given by his company, while surfing the Internet in November 2008.

By using the data source and code of the complainant’s company, Inamdar and others cheated the company to the tune of Rs47.5 crore annually.

Moving the application seeking discharge from the case, Thorwe and Jangam’s lawyers told the court that there is no material to justify the charges u/s 406, and 420 of IPC for want of proof of essential ingredients of those offences.

The assistant public prosecutor, Harishchandra Dhoiphode, said there is sufficient incriminating evidence on record to prove all the allegations against the accused. The court said prima facie the accused is guilty of the offence punishable under the Indian Copyright Act and partly rejected the application.

Money, jewellery stolen from flat
Two unidentified persons broke into a flat and decamped with Rs50,000 and gold ornaments worth Rs4.94 lakh on Thursday afternoon in Aundh.

Wani Rangrao Desai (36) of Aundh lodged a complaint with the Chatuhshrungi police station. According to the police, Wani had locked her flat and gone to pick up her daughter from a school when the burglary happened.

Two unidentified persons broke the lock of the flat and got away with the cash and valuables kept in a cupboard.

The incident came to light, when the complainant returned to her house around 1 pm and found the door open. She saw two persons inside the flat, who fled after seeing her.
