Bombay high court permits police inquiry against Shiv Sena rally organiser

A local court granted permission to the city police on Wednesday to conduct an inquiry against the organiser of Shiv Sena’s annual Dusshera rally under the Environment Protection Act for flouting the Noise Pollution Control Rules.

A local court granted permission to the city police on Wednesday to conduct an inquiry against the organiser of Shiv Sena’s annual Dusshera rally under the Environment Protection Act for flouting the Noise Pollution Control Rules.

“Under this act, the offender is liable to pay a fine of Rs1 lakh or face imprisonment of up to five years. We have also included sections of the noise pollution act apart from the Bombay Police Act 33(R),” said senior inspector Suresh Unawane.

The police had, two days ago, registered a case against the rally’s organiser, Diwakar Bodkar, and two other party workers, Anil Parab and Milind Vaidya, under the Bombay Police Act for exceeding the 50 decibel noise limit laid down by Bombay high court for the rally at Shivaji Park.

The police said the FIR also names Parab and Vaidya as they were the ones who had filed petition in the HC and assured the court that they would not flout the rules. Parab, however, said the party has already declared its position in this case through the editorial in party mouthpiece Saamna on Wednesday.

Thackeray, in his editorial, wrote: “If these fiery speeches are creating noise pollution then the police are free to file that complaint and continue with the investigation.”
