Bombay HC questions restrictions on Nooriya’s Haveliwala foreign travel

The Foreigners Regional Registration Office (FRRO) was rebuked by the Bombay high court for opposing the bail of Nooriya Haveliwala, the US citizen who was allegedly booked after her speeding Honda City car knocked the life out of two persons, including a traffic cop, last year.

“She is on bail. Can’t she go underground now also?” asked the high court on Thursday while questioning the FRRO’s restriction order against Nooriya Haveliwala that prevents her from leaving Mumbai. “How can you restrict her movement on the moral grounds that no Indian will do it. It was an accident and not done in a pre-planned manner?” the high court asked.

The division bench of Justice A M Khanwilkar and Justice Rajesh Ketkar, while suggesting the FRRO to reconsider its decision and approach the necessary court for cancelling the bail granted to Haveliwal said, “Bail is not cancelled, so what’s the apprehension. Move for cancellation of bail, place material before the court. As of now, you are overreaching the court power, which granted bail to the petitioner.”

Haveliwala was recently issued a fresh ‘restriction order’ by the Foreign Regional Registration Office (FRRO), stopping her from going abroad for her professional assignment. The authority in their order states that if she is allowed to go out she won’t be back to face the criminal trial in which charges against her have to be framed and the case is likely to commence.
