Bombay HC grants Mercedes officials extension on interim bail

The Bombay high court on Thursday granted a week-long extension — till March 4 — to the interim bail to six top officials of Mercedes-Benz India including its CEO and managing director Wilfred Aulbur.

Additional sessions judge OP Jaiswal on Tuesday had directed top officials of Mercedes-Benz India to seek bail from the high court to avoid arrest in a forgery case. The six had rushed to a Shivajinagar court on Monday seeking interim anticipatory bail in the case filed by city-based auto dealer Millennium Motors Private Limited.

Hearing an application, justice BR Gavai directed the investigating officer to file an affidavit by March 4.

Justice Gavai also observed that till further hearing, the order of the sessions court would be continued. The court also granted relief to the three directors, two general managers and one divisional manager from personally attending the proceedings.
Last week, Mercedes officials had moved the high court in connection with the same case.

Judge Jaiswal on Tuesday had said the matter was being heard by the high court and it was not in his jurisdiction to hear the case.
The high court, in its order on February 18, stated that in the event of the arrest of these six officials in connection with the complaint filed by Millennium Motors or any of its officers on its behalf, the applicants be released on bail on furnishing bail bonds of Rs25,000 each.

Besides Aulbur, Debashish Mitra, director (sales and marketing), Uwe Jarosch, director (finance), Puneet Chug, general manager (network development), and Bhishma Patel, general manager (finance), had approached the city court on Monday afternoon seeking bail.

Millennium Motors chairman Dipak Naik has charged that Mercedes-Benz had terminated its dealership contract in November last without prior notification.
