BMC’s duty to give clean water, clear air: Bombay high court

The BMC was held responsible for providing clean drinking water and pollution-free air to citizens by the Bombay high court on Thursday.

Coming down heavily on developers who fail to clear debris after construction, the court suggested that the BMC should consider prosecuting developers who do not clean the area after construction.

The court was hearing a public interest litigation filed by two social activists, highlighting how two women Vrushali Pawar, 26, and Kavita Aitala, 23, residents of a Worli slum, had died of jaundice in April 2010.

BMC’s counsel filed an affidavit before the court stating that the developer had diverted the pipelines and the surrounding areas near the tap were unhygienic, because of which possible illnesses could have happened.

The petitioners’ counsel told the court that residents of Harmony Tower, which is built under the slum rehabilitation scheme, were provided with clean water.
