Army man hails Bombay high court direction

The Bombay high court, on Friday, directed the Indian Army to release Sayankar so he can marry his fiancé Shruti Kulkarni, a non-resident Indian staying in the US.

The Bombay high court, on Friday, directed the Indian Army to release Sayankar so he can marry his fiancé Shruti Kulkarni, a non-resident Indian staying in the US.

In an email interview to the DNA, Sayankar said “The wait has been long and unnerving. However, I would wait for the order to be officially out”. Sayankar and Shruti are scheduled to get married on May 28.

The high court directed the Army to release Sayankar within one month but with a condition that the release would be effective only after he provides proof of the marriage. “As per the army order I can marry and later seek permission for release but, in that case, I would be terminated and will have to face consequences later. I am a law-abiding citizen and if terminated from the Indian Army, my future will be uncertain. So, I want to be released, not terminated”, Sayankar had argued in court.

In March 2009, Sayankar was posted in Kargil and came down to meet his parents in Pune where he met Shruti. Before Sayankar resumed work, the two got engaged on December 25, 2009.

Sayankar applied for release permission from the Army but it was rejected four times without providing any reason. The couple approached the high court last year. The army opposed it saying “he was making a backdoor exit in the guise of marriage which he wouldn’t do anyway.”
