Adarsh-tainted presiding officer must go, says Shiv Sena

The Sena has written a letter to speaker Dilip Valse-Patil seeking Avhad’s ouster from the panel of the presiding officers.

The Adarsh Cooperative Housing Society scam continues to heat up the winter session of the state assembly. On Thursday, the circle of fire surrounded Jitendra Avhad, presiding officer in the state assembly, as the Shiv Sena demanded that he be removed from the post as he is one of the members of the controversial Adarsh society. 

The Sena has written a letter to speaker Dilip Valse-Patil seeking Avhad’s ouster from the panel of the presiding officers. “He is one of the allottees in the controversial society. We cannot follow his orders as the presiding officer of the sacred chair of the speaker,” Sena group leader Subhash Desai said.

Avhad is one of the six presiding officers in the state assembly. Flat number 59 of the Adarsh society has been allotted in his name.

The letter also states, “The Central Bureau Of Investigation has been enquiring into the matter and the defence has raised strong objections on the construction of the high-rise on the land owned by it. In this backdrop, tainted officers like Avhad cannot continue in the chair.”

When asked how his party expects action against Avhad even before the investigating agency has reached any conclusion, Desai said, “Ashok Chavan had to resign as the chief minister even before any official complaint was lodged. Here, the question is about the sanctity of the chair of the speaker. We want firm action on this by the speaker,” he said.

Bench recuses itself
A division bench of the Bombay high court which was to hear the Adarsh society case on Thursday recused itself from hearing the proceedings.

The division bench of justices Dhananjay Chandrachud and AV Mohta were to hear a petition filed by the  residents of Adarsh Cooperative Housing Society challenging the cancellation of the occupation certificate and electricity and water supply cuts. The parties will have to move the court authorities for constitution of a new bench. “No reasons were assigned,” said the society’s lawyer Satish Maneshinde.

Mumbai Metropolitan Region Development Authority (MMRDA) had cancelled the occupation certificate of the controversial building, while the Brihanmumbai Municipal Corporation cut the water and power supply to the building on November 3.
