Adarsh scam: Why missing files case not clubbed with main scam, asks court

After the scam came to light, 4 pages of the Adarsh file, pertaining to the deletion of a nearby road from the plan to give more FSI to the society, and coastal regulation zone clearances, were found to be missing.

Remanding three Maharashtra government officials in CBI custody till May 10 for their alleged complicity in the Adarsh Society missing files case, a local court today asked why the agency did not club the case with the main housing scam.

Desk officer Gurudatt Wajpe, assistant town planner NN Narvekar and Waman Rawool, all officials of the urban development department, were arrested last evening by CBI, after Bombay High Court rapped it for slow pace of the probe.

When the three were produced for remand today, magistrate DH Sharma said, "Both the cases are pertaining to one scam. They are inter-connected, then why don't you amalgamate them?

"By arresting three persons in a petty theft case you (CBI) are diverting people's attention from the main scam. And no one has been arrested in the main case. What is the progress in that case?"

However, the judge also held that looking at "sensitivity of the matter and public interest involved, CBI must be given a chance to interrogate the three accused. It is also needed to trace the whereabouts of the missing files and ascertain probable involvement of other persons."

"But show some progress on the next date before seeking extension of their remand," the court remarked.

After the scam came to light in September last year, four pages of the Adarsh file, pertaining to the deletion of a nearby road from the plan for giving more FSI to the society, and to coastal regulation zone clearances, were found to be missing.

"The pages from the file are important documents related to the scam in which high-ranking officials and politicians are involved. The three arrested accused were asked to misplace the pages at the behest of senior officers," CBI counsel Bharat Badami, told the court.
