Adarsh scam: Govt gears up for court battle

A day after an FIR was filed against several IAS officers and former chief minister Ashok Chavan, the government was under severe pressure to hand over the case to the CBI.

The government will have to prepare its case as the Adarsh Housing Society plans to take its battle to court and expose the roles of various nodal agencies such as urban development department, MMRDA, and BMC.

A day after an FIR was filed against several IAS officers and former chief minister Ashok Chavan, the government was under severe pressure to hand over the case to the CBI.

Also, questions were doing the rounds why prominent players and senior bureaucrats who cleared the files had not been named in the FIR. Chief minister Prithviraj Chavan too is under pressure to suspend all IAS officers, who have been named in the FIR, immediately.

A source in the chief minister’s office (CMO) admitted that the government was under pressure. “But there is no question of handing over the investigations to the CBI as we have already set up a judicial inquiry to find out the role of bureaucrats,” he said.

“We will wait for the report before taking any action against serving IAS officers.”

The government has, however, directed its legal department to get prepared with all documents.

The source said that the government would strictly adhere to the directives issued by the court and the centre. “If the union government, supported by the court, orders a demolition of the building it will be carried out,” he said.

The CMO is worried that the government might be caught on the wrong foot because of administrative lapses. Another source said, “The urban development department, which is headed by the chief minister, will have to explain why it allowed the violation of development control rules. Also, on what basis did the MMRDA issue an occupancy certificate to the Adarsh Society on September 16, 2010?”

Lawyer activist YP Singh said there were discrepancies in the FIR. “Why were former chief ministers Sushil Kumar Shinde and Vilasrao Deshmukh not named in the FIR?” he asked. “There are prominent bureaucrats who cleared the files. Their signatures are documentary evidence but they too haven’t been named.”
