Absentee prosecutor in PCPNDT case sacked

The state government on Tuesday told the Bombay high court that the Solapur additional public prosecutor, who allegedly remained absent from the hearing of a criminal appeal against a doctor charged under the Pre-Conception and Pre-Natal Diagnostic Techniques (PCPNDT), Act has been terminated from service.

The state government on Tuesday told the Bombay high court that the Solapur additional public prosecutor, who allegedly remained absent from the hearing of a criminal appeal against a doctor charged under the Pre-Conception and Pre-Natal Diagnostic Techniques (PCPNDT), Act has been terminated from service.

The division bench of justices SA Bobde and MR Bhatkar of the HC was informed that the prosecutor was terminated after an inquiry by a high-powered committee. As per the inquiry and the observations by the high court during the hearing of a plea filed against the prosecutor, the state deemed it fit to terminate the service of M Sadaphule.

Earlier, the bench said: “Non-appearance in court is the first sign of dereliction of duty, apart from being another kind of trick adopted by prosecutors, we hope you’re aware of this. Until the completion of inquiry, the prosecutor should not be given any cases to further the cause of the state.”

The bench was hearing a public interest litigation filed by Solapur-based advocate and social activist Prakash Pise seeking action against such prosecutors.  Appearing for the petitioner, advocate VP Patil argued that M Sadaphule’s non-appearance in hearings had led to the acquittal of a doctor, who was accused of carrying out sex-determination tests.
