8 Mumbai policemen accused of framing builder get relief

Mumbai: In major relief to eight suspended police personnel, including IPS officer Bipin Bihari, a local court today rejected the adverse report submitted against them by the Maharashtra Criminal Investigation Department in a case relating to the frame-up of builder Rajendra Chaturvedi.

The CID in February 2008 filed a 'B' summary report before the Andheri metropolitan magistrate stating that the complaint lodged by the police against Chaturvedi in 2007, accusing him of ordering a hit on rival builder Rashmikant Shah, was wrong and lacked evidence.

But the court today rejected the report, observing that the facts presented by the CID were unsatisfactory.

"The court cannot accept this report and the CID should verify the facts and investigate the matter again and submit a fresh report," magistrate KD Chowdhary said.

Eight police personnel, including Bihari, who was then additional commissioner of police (western region), senior inspector Pradeep Shinde, and inspector Jagdish Sail were suspended in March 2008 following the CID report.

Today's order comes as a huge relief to the suspended personnel. The CID has been asked to verify the facts again after which it has to submit a second report in court, Laxman Kanal, counsel for Bihari, said.

On February 24, 2007, police in Juhu had arrested four men for allegedly planning to kill Shah. The four men allegedly told the police that they were given a supari (contract) by Chaturvedi to kill Shah.

According to the police, Chaturvedi and Shah were in the fray to redevelop the Abhyudaya Nagar colony at Kalachowkie in Central Mumbai, a project that is believed to be worth at least Rs500 crore.

After Chaturvedi alleged in court that he had been framed by the police, the CID started its own inquiry into the matter.
