Vijay Mallya declared proclaimed offender on ED's plea

The court declares someone a 'Proclaimed Offender' when an accused has a non-bailable warrant pending against him and he has absconded or concealed himself so as to prevent the execution of such warrant.

Liquor baron Vijay Mallya was declared a proclaimed offender in a money laundering case under Section 82 of the CrPC by a special court on Tuesday.

The court declares someone a 'Proclaimed Offender' when an accused has a non-bailable warrant pending against him and he has absconded or concealed himself so as to prevent the execution of such warrant.

Reportedly, Mallya fled the country on March 2, 2016. Consequently, the court issued a non-bailable warrant against him on April 18. By declaring him a proclaimed offender, the court has given him a final chance to appear before the court. If he fails to do so in the next 30 days, all his properties would be attached and sold by the government.

Hiten Venegaonkar, the lawyer representing the ED, said that Mallya has failed all the orders to return to India. Thus, the investigation has come to stop. The ED went to all the available addresses but to no avail.

Mallya released a statement two days ago calling the investigations against him 'heavily biased' and denied all charges against him. He claimed that he was being held guilty without trial. He said: "Purely civil matters such as loan recovery are being connected with criminal allegations without any basis whatsoever."

The agency can now approach the ministry of external affairs for a red corner notice against him. The red corner notice would be issued by the Interpol to ascertain the location of the offender and subsequently, the arrest would be made.

Mallya's passport has already been cancelled. Though, Britain has turned down the formal request to deport Mallya, but it will help with the process of extradition. The ED is probing a Rs900 crore IDBI bank loan default case against Mallya under the Prevention of Money Laundering Act.
