Tribunal awards Rs 3.8 cr to accident victim’s family

The Motor Accident Claims Tribunal (MACT) has awarded a compensation of over Rs 3.8 crore to the Kandivli-based family of a marine electrical engineer who was killed in a road accident in February 2012. The tribunal held that the deceased was a person who would earn a monthly salary of Rs 4 lakh, and since his death was a terrible loss to the family, the high compensation of Rs 3,89,93,000 was being awarded.

Rakesh Baluni, the accident victim, was 50 years old at the time of his death. On February 21, 2012, when Rakesh was riding his bike on the Jogeshwari-Vikhroli Link Road, his vehicle was dashed by a motor tanker, and following this he succumbed to his injuries.

The victim’s family put on record the police statements and the hospital papers which would prove the victim’s case. After verifying the documents, the tribunal sought a response from the driver of the tanker and the insurance firm concerned. The insurance firm, in its reply, maintained that the driver of the tanker was not holding a valid licence, and thus it was a breach of trust from the owner of the tanker. It also contended that it could not be said that the deceased was riding the bike safely, and that he may have been negligent too.

After going through the evidence, the tribunal rejected the say from the insurance firm, and directed it and the owner of the tanker to cough up the compensation.
