On Thursday, Shalaka Gore (name changed), a Paachpakhadi resident who works in a bank in Thane filed a case against Darshan Gandhi and Natwar Banki of Loknagari Builders. In her complaint, Gore said that in June 2014 she had booked a flat in the A/4 building, phase III at Ambernath East.
A Thane resident has filed a case against Loknagari Builders for delaying possession of his flat at Ambernath. The complainant alleged that even after making full payment the builder has not given the flats for more than two years.
On Thursday, Shalaka Gore (name changed), a Paachpakhadi resident who works in a bank in Thane filed a case against Darshan Gandhi and Natwar Banki of Loknagari Builders. In her complaint, Gore said that in June 2014 she had booked a flat in the A/4 building, phase III at Ambernath East.
"Initially, we paid a booking amount of Rs6.38 lakh of the total amount of Rs19.38 lakh for the flat. Later, we paid the entire amount through several cheques to the builder. The buyer's agreement was also made during the course of payment and they were to give us possession by December 2014," she said.
However, even after making full payment what Gore got was just plain assurances. "The developer kept saying that the work of the project had stopped and they will start it in the next eight days. But till now, nothing has moved," she said.
Hence, she filed a case against the developers at Shivajinagar police station, Ambernath under sections 406 (criminal breach of trust), 420 (cheating), 34 (common intention) of the IPC and Maharashtra Ownership Flat Act, 1963. "Like me, over 400 people have been cheated by these developers," she added.
When this correspondent tried contacting Banka and Gandhi, they were not reachable on their phones.
The police said that the matter is under investigation.
