TADA court pulls up police in Karimi case

The Special TADA court on Thursday pulled up the prosecution and the police for failing to do their homework on the extradition laws, after they had approached the court seeking cancellation of bail of Salim Karimi, against whom a Red-Corner Notice (RCN) has been issued by the United States of America (USA) government.

Judge Govind Sanap also asked Joint Commissioner of Police, Crime, Mumbai to attend the court on Friday and explain the procedures taken by the police till date in connection with the extradition of Karimi.

According to police, it is alleged that Karimi had committed fraud worth millions of dollars through an overbilling scam in USA, in which he submitted fraudulent bills for affordable housing projects.

After committing the alleged fraud, Karimi had escaped to India in 2010 and was arrested by the Mumbai police in 2015 from Mumbai's international airport. However, he was later released on bail and the prosecution currently is arguing on the cancellation of his bail stating that they want to approach the Ministry of External Affairs to act on the communication sent by the USA government in February 2016 and work on the extradition process.

The court raised several questions — why was no procedure initiated in connection with the extradition of the accused? When did the police receive an extradition request from the USA?

If extradition request is received from the government of the USA, then who had to file the proceedings before the extradition court? Any proceeding is initiated before extradition court on basis of requirement of court of the USA? Whether arrest of the accused after granting him bail is necessary before initiating extradition proceedings before the extradition court?
