Supreme Court refuses to vacate stay on Bombay High Court's order on Metro fare hike

On Wednesday, the Supreme Court refused to interfere in the ongoing petition in the Bombay High Court over Versova-Andheri-Ghatkopar Metro fares.

Reliance Infrastructure (RInfra)-led Mumbai Metro One Private Limited (MMOPL) had moved the apex court to get relief from the interim order of the Bombay High Court. If the Supreme Court would have granted relief, it would have paved way for MMOPL to increase metro fares.

On Wednesday, the division bench of justices MY Eqbal and Arun Mishra asked MMOPL to approach the Bombay High Court itself by refusing to hear their special leave petition.

On December 17, the Bombay High Court, in an interim order, had stayed increasing of metro fares above Rs40, after the MMOPL had announced the hike in fares into five slabs of Rs10-20-25-35-45 as per the recommendations of the FFC. The fare was to be hiked from December 1.

The Mumbai Metropolitan Region Development Authority (MMRDA) wants the fare to be Rs9-11-13, but MMOPL has been permitted by FFC to increase fare up to Rs110 between Versova and Ghatkopar.

The next hearing on the case in the Bombay High Court is scheduled for January 29.

The RInfra-led MMOPL and MMRDA are at loggerheads over the fare issue of the metro ever since the Mumbai's first metro rail between Versova-Andheri-Ghatkopar was inaugurated on June 8, 2014.

The MMRDA wants RInfra-led MMOPL to honour the fares mentioned in the Concession Agreement, whereas, MMOPL wants to increase the tariff "as it is operating in loss and cost escalation of the metro project" since the inauguration. As per the Metro Railway Act, MMOPL being the metro rail administrator is permitted to revise metro fares.
