Mumbai: Shiv Sena threatens to take to streets over Metro Railway Act

Sena said that if the Metro will displace the residents of Girgaum and affect the residents of other areas who have been living here for decades, the party will fight against the state government for the rights of the residents.

Shiv Sena has decided to take on municipal commissioner Ajoy Mehta over the Metro Railway issue. Shiv Sena on Monday said that it will oppose Metro Railway Act of 1978 if that has been cited to encroach upon their rights in the BMC.

Sena said that if the Metro will displace the residents of Girgaum and affect the residents of other areas who have been living here for decades, the party will fight against the state government for the rights of the residents.

Yashodhar Phanse, chairman of standing committee and Trushna Vishwasrao, Leader of the House said that Sena will take to streets if needed to stand by the residents affected by the Metro Project. Several parts of Girgaum are affected due to Metro alignment. At least three buildings are said to be coming in the way of Metro Railway route which would require these buildings to make way for the rail route. There is stiff opposition among residents over the plan.

The revised Development Control Regulations (DCR) says that any alignment modifications introduced in Metro/Mono/Elevated Corridors/Corridors of Mass Rapid Transport System, including BRTS, by the Appropriate Authority and sanctioned by government will be automatically get amended on the Development Plan as modified.

This means, that any changes done in the route of these projects will be automatically changed in the Development Plan without any sanction from the civic body.

Revised DCR also paves way for any new "Transport Corridor" such as Metro/Mono/Elevated Corridors/Corridors of Mass Rapid Transit System, including BRTS, which may come in future as proposed by appropriate authority and sanctioned by government, will also automatically added on to Development Plan.

Shiv Sena, last week, had raised objection over the provisions made by the civic chief in the revised DCR and had cleared that the party will not allow their rights to be encroached upon. Party, on Wednesday came down heavily on Bharatiya Janata Party (BJP)-led state government and alleged that it was trying to control the civic administration by using municipal commissioner who attempted to cut the powers of Sena-led civic administration.

Later, municipal commissioner Ajoy Mehta, cited the Metro Railways (Construction of Works) Acts, 1978 of the Central Government, which clearly gives the right to the authority developing the transport corridors to decide the realignment in any metropolitan city which may include any building or land or planting of any tree and redevelopment. "The act clearly states that no other act can affect the parent act which also governs Bombay Municipal Corporation Act 1888 (Bombay Act III of 1888). This leaves no scope for me but to make changes for the development of transport corridor for the city," Mehta had said.
