Shah Rukh Khan gets Bombay high court order to restrain piracy of his upcoming release Happy New Year

The Bombay high court has granted interim relief to Bollywood actor and producer Shah Rukh Khan, who had approached the court seeking injunction against cable operators and other unknown people from airing/selling pirated version of his soon-to-be-released film Happy New Year.

Khan's production house Red Chillies Entertainment Private Limited had moved a suit in court under the Indian Copyright Act.

The film will release on October 24. The production house, represented by counsel Venkatesh Dhondh, argued that apprehensions that the film would be telecast on cable TV channels or its pirated copies would be sold in the open market in the form DVD, Blue-Ray prints, CD or VCD are there, going by previous experiences. Thus, it has moved for restraining Hathway Cable, Datacom Limited and others from doing this.

Further, the injunction sought does not pertain to any internal dispute regarding the production of the film but seeks only to restrain potential damage and loss likely to be caused to the company, if these pirated copies are allowed to flood the market.

The court, after hearing the Dhondh and relying on HC orders in other similar cases, said, "Pending the hearing and final disposal of the suit, the defendants by themselves, their servants, agents, licensees, franchisees, partners, proprietors and/or otherwise howsoever be restrained from telecasting/broadcasting/distributing/putting on the cable TV network/disseminating/reproducing or otherwise making available to the public, the film Happy New Year."

Further, the defendants are restrained from making a copy of the film, sell or give on hire, or offer for sale or hire, any copy of the film. The court also directed the police to render necessary assistance to the production house in restraining the defendants from violating/infringing the film's copyright.

The court, while adjourning the hearing on the suit to November 24, directed the defendants to file their affidavits in reply.
