"Selling of wife's gold ornaments to live a lavish lifestyle and then not take care of one's wife and child, does amount to cruelty towards wife," held the family court while granting divorce to a 43-year-old woman. Tired of her husband's careless attitude towards the family, the woman had approached the court for divorce after 16 years of their marriage.

The couple got married on May 11, 1999. As per the woman's plea, her husband always indulged in a luxurious lifestyle, but she came from a very simple and grounded family. Most of the times, he used to come home in an inebriated state. There were times, the woman recollected, when her neighbour had come up to her to inform that her husband was lying in the gutter. Although it was very embarrassing for her, she adjusted herself to such situations.

In her plea, the woman further claimed that when she had been to her maternal place for the delivery of her child, her husband rented out half of their house, making it extremely difficult for her to stay there anymore. Once when the husband had run short of money, he sold off woman's gold ornaments and continued to indulge in his luxurious lifestyle.

When the court asked the man to file his reply, he did not respond. Thus the court held that since the woman's allegation were not contested by the man, it was proved that the woman was forced to cruelty in the hands of her husband. The court, therefore, granted divorce to the woman.
