The magistrate court on Monday once again granted exemption to actor Saif Ali Khan from appearing before the court and adjourned the matter to June 18. The court, however, has asked the actor to remain present on the next date, failing which it will issue a bailable warrant against him.

Speaking to dna, public prosecutor Wajid Sheikh said, "The prosecution was about to examine the complainant, Iqbal Mir Sharma, on Monday.

Accordingly, Sharma came to India from South Africa. However, Khan's lawyer informed the court that he would not be able to attend the court. Khan's lawyer claimed that the actor was in the midst of shooting an advertisement in Bangkok and that he could not attend court since he had already signed a contract with Procter and Gamble (P&G)."

The prosecution as well as the complainant had opposed the plea of Khan's advocate and the prosecution filed an application before the court pleading it to issue a warrant against the accused. However, the court adjourned the orders on the application to the next date. "The actor's advocate informed the court that his client would be present on the next date. However, in case he fails to do so, the court would issue a warrant against him," said Sheikh.

Meanwhile, the other two accused, Bilal Amrohi and Shakeel Ladak, were present before the court.

According to the prosecution, the actor and his two friends were arrested following a complaint filed by the businessman, Iqbal Mir Sharma, after an alleged fight at the Wasabi restaurant inside Taj Hotel on February 22, 2012.

They were later released on bail. Saif was accompanied by actresses Karishma Kapoor, Kareena Kapoor, Maliaka Arora Khan, Amrita Arora and some male friends at that time. Police claimed that Saif assaulted the complainant when he protested against the loud chatter of the actor and his friends.
