Road-and-desilting scam: Bombay HC asks Mumbai police to continue investigations

The Bombay High Court on Tuesday observed that the Anti-Corruption Bureau (ACB) has a very low conviction rate in cases, and thus asked for the continuation of the Mumbai police’s investigations into the alleged, road-and-desilting contract scam.

A division bench of Justice V M Kanade and Justice P R Bora, has also asked the government whether it was funding projects being carried out by the Brihanmumbai Municipal Corporation (BMC). The court wondered if the answer was in the affirmative, how were the funds allocated to the projects being monitored the observations were made during the hearing of a public interest litigation (PIL) filed by a Bhartiya Janata Party (BJP), member, Vivekanand Gupta.

The petition states that Gupta is a municipal rate payer, concerned about the welfare of the city and its citizens. He is a practicing advocate and social/political activist and an officer bearer of BJP Mumbai. His petition asked for transfer of probe in the road and desilting contract scam from city police to Anti-Corruption Bureau (ACB), saying it would expose the “unholy nexus” between contractors and civic staff.

It further said that there was water logging in the city on July 19 and 20, last year due to heavy rains following which Municipal Commissioner (MC) had ordered an inquiry into the desilting contract work. The probe revealed the “unholy nexus” of contractors and civic officials.

Subsequently, the Commissioner ordered the filing of an FIR against contractors involved in the desilting scam. BMC has, in an affidavit filed earlier, said that action on the contractors follow the complaint for registering FIR by the Municipal Commissioner and that civic body. It has also suspended few high-ranking officials of the corporation, thus proper action as per law would be initiated.
