Rabiya Khan says she won't make defamatory statements against Pancholis

Rabiya Khan, mother of actor Jiah Khan who allegedly committed suicide last June, told the high court on Wednesday that she will not make any defamatory statements against Sooraj Pancholi, who is a prime accused in the case, and his family till the date of the next hearing.

Khan, who is facing a Rs100 crore defamation suit filed by the Pancholis, made the statement through her counsel Subhash Jha before the HC.

This means that she will not be able to make any defamatory statements on social media like Twitter.

She also told the court that her Twitter account had been hacked at various times in the past.

Representing Khan, Jha said, "I have a Twitter account which I have been operating since many years. It has also been hacked a few times. I don't have to do anything with a few comments in the past. But I will not tweet anything in the future."

However, this will not restrain her from saying anything to the prosecuting agencies like the police or the Central Bureau of Investigation. "She can make the same statements before the prosecuting agencies," said justice SC Gupte while accepting her statement.

The Pancholis told the court through their counsels, Jay Prakash Sen and Prashant Patil, that Khan had continued to make slanderous remarks against them on her Twitter account, even after they filed the suit in the high court.

Following this, they filed an additional affidavit attaching copies of her defamatory statements.

Meanwhile, Khan also sought further time from the court to file a reply to the defamation suit, saying that she was going abroad for a few days. She is a British national.

The HC has granted four weeks to her for filing a reply.

The Pancholis have been given time till August 25, the next date of hearing, to file a rejoinder, if any.

The Pancholis also sought restrain on Khan from further defaming them on social media.

The suit alleges that Khan, a UK national, had posted slanderous, defamatory and abusive comments on Twitter, which had put the Pancholi family in poor light in the eyes of the society.
