Prosecution pours scorn on Salman Khan's defence in hit-and-run case

Why did actor Salman Khan's defence lawyer wait until the fag end of the hit-and-run case against Khan to bring on record the claim that Khan's driver was driving the vehicle, asked special public prosecutor Pradeep Gharat on Wednesday. Gharat raised this doubt during his final arguments in the case, which was registered in 2002, and which is being presided over by judge DW Deshpande.

"It was only when the actor was recording his statement under section 313 CrPc that he mentioned the fact that it was his driver who was driving the car. It was the prosecution's case that at the time of the incident, there were three persons who were travelling in the car, singer Kamaal Khan, Salman's bodyguard Ravindra Patil and Khan himself. Further the accused has given a three-paged statement describing the same, however he did not keep the option of cross-examining him (Salman) open. If the prosecution had to cross-examine him, the cat would have been out of the bag, but he denied being cross-examined," argued Gharat.

The prosecution further claimed that the defence conveniently framed the entire incident as an 'Act of God', by saying that it was caused by the mechanical fault of the car. "From the examination of the defence witness, the driver Ashok Singh, it is clear that the vehicle, which according to the prosecution, Salman was driving, was a luxury car. It had a panel which would indicate if there was any fault, and it can be clearly said that Salman had neglected the notifications given by the car on its panel, which thus led to the situation of injuring three and killing one," added Gharat.

The prosecution is about to continue with its final arguments on April 6.
