Playgrounds in Cuffe Parade free from encroachment: Collector to Bombay High Court

The Bombay High Court on Friday disposed of a Public Interest Litigation that had alleged misuse of two government-owned plots reserved for playgrounds in Cuffe Parade after the collector assured the court that there was no misuse and the land was open for public use.

A division bench of Justice Abhay Oka and Justice A S Gadkari accepted the collector's statement that the plot was not issued to anyone and no sign boards or illegal parking of cars would be allowed.

The court was hearing a petition filed by NGO Friends of Society, which represented the fishing community living in Bhai Bhandarkar Area. They fisherfolks had moved the HC alleging that the Cuffe Parade Residents' Association, which had adopted the plots, was using them for parking cars of its members and not allowing the public to use them.

Advocate Makarand Kale, who appeared for the petitioners, informed the court that he had visited the spot and found that plots had been restored and were open for public.

The petition claimed that prior to 2000, the plots were used by local fishermen to park their vessels and dry fish. In subsequent years, the land was reserved for playground. From June 2003 to May 2003 the association, which had adopted the garden, allegedly carried out illegal activities. The fishermen had staged protests in January 2004 with the district collector, civic body and other authorities. However, since there was no relief, they approached the HC.
