Petition seeks to nullify Narendra Modi's election from Varanasi

Social activist and president of Desh Bachav Party Hemant Patil has filed a writ petition in the Bombay high court seeking to nullify the election of prime minister Narendra Modi from the Varanasi seat. Patil has alleged that Modi spent more than the limit fixed by the Election Commission of India (ECI) on campaigning.

The petition, filed on Tuesday, has Modi as a respondent. It will come up for hearing in due course of time.

Alleging large-scale corruption and irregularities during the last Lok Sabha election, Patil claimed that various political parties and their candidates spent more than the limit fixed by the ECI.

"Respondent number 3 (Modi) has expended more than (the) limit fixed in his Lok Sabha constituency at Banaras and all over India for his party. He has taken support of various capitalists, including Ambani and Adani..." alleges the petition.

In spite of this, the ECI neither restricted him nor initiated any legal action against him, said Patil.

According to Patil, he had submitted a written complaint to the ECI on March 29 with respect to the violations of various provisions of the People Representatives Act and the Indian Penal Code. However, till date, he hasn't received any reply.

For spending more than the fixed amount of Rs70 lakh, Modi's election should be nullified from Varanasi, and also for leaving column about his wife's income and taxation details blank, prays the petition.

It further claims that by spending crores in each and every constituency in Mumbai, Pune and all over India, Modi has shown "muscle and money power". "The same is nothing but misleading people and instigating people to vote for them..." reads the petition.

The PIL has sought that the Union government and the ECI conduct an inquiry into the alleged illegalities, take necessary action and file a detailed report before HC.
