Pay Rs4 lakh to acid attack victim: Bombay High Court to Maharashtra government

Aarti Thakur (25), an IT firm employee, was attacked with acid at Goregaon railway station on January 31, 2012. She is scheduled to undergo plastic surgery among other operations at the Nova Specialty Hospital.The state had earlier said that Aarti's case cannot be considered for grant of monetary compensation under the Manodhairya scheme launched on October 2, 2013, as the incident was of a prior date. The bench, though, said there could not be a cap on the date of compensation in such a case, and that the state needed to extend the aid to the victim. It described the setting of a cut-off date as arbitrary.The court had on March 17, asked the government to respond by Thursday whether it was ready to bear the medical expenses of Aarti's surgery. However, the government failed to give any concrete reply and maintained that her case was not covered by the Government Resolution of 2013.

To this, the court said, "Despite giving time, the state government has not responded. We are informed that Aarti is scheduled to undergo surgery next week and it cannot be delayed due to pus formation on her injuries. We direct the hospital to ensure that she is operated without waiting for the money."The court was hearing a public interest litigation filed by an NGO, Forum Against Oppression of Women, highlighting inordinate delays in implementing a scheme for compensating and rehabilitating rape survivors - envisaged in the apex court's decision of 1994 - and a petition filed by Aarti Thakur, seeking compensation of Rs30 lakh from the state.
