Pay kin of mishap victim, risk firm told

The Motor Accident Claim Tribunal (MACT) has ordered a vehicle driver and Bajaj Allianz General Insurance to pay compensation of Rs 15 lakh to three children who lost their mother in a road accident in 2006. Family of deceased had demanded a compensation of Rs 7 lakh, however, the Tribunal ordered a compensation of Rs 15 lakh by taking into consideration the probable age that the deceased woman would have lived and her monthly salary. The order stated that, of Rs 15 lakhs, Rs 1 lakh is towards the loss of love and emotions caused to the children due to their mother's death.

On June 21, 2006, Powai resident Saleha Khan, who was on her way to Ajmer in a jeep met with an accident.

According to Khan's children, the driver was rash in his driving and negligent leading to the mishap near Chitra Shani village in the jurisdiction of Palanpur police station. While all others in the jeep survived with grievous injuries, Khan succumbed to her injury. A case was later filed by Khan's family against jeep owner and driver Mohammed Hanif Qureshi and the insurance company.

The insurance company in its reply claimed that Qureshi did not have a valid driving license, and as it was his fault which led to the mishap, hence the insurance company does not deserve to honour the claim.

The Tribunal, however, held the driver and the insurance firm guilty of Khan's death and asked them to pay off the compensation amount.
