Pay compensation to woman for delay in lodging her FIR: Commission

According to the Commission, on April 20, 2014, complainant Sonal Chavan's daughter got burnt while going to the neighbour's house for a birthday party, as someone had poured hot oil on her.

The Maharastra State Human Rights Commission (MSHRC) on Thursday, directed the State Home Department to pay a compensation of Rs 25,000 to a Dadar-based woman after Bhoiwada police delayed registration of her First Information Report (FIR) for two months.

According to the Commission, on April 20, 2014, complainant Sonal Chavan's daughter got burnt while going to the neighbour's house for a birthday party, as someone had poured hot oil on her. The victim kept visiting the police station to register a complaint against the accused, but the police did not entertain her complaint.

"Her FIR came to be registered on June 08, 2014 that is almost two months after the incident, despite the fact that the nature of the allegations very clearly made out a cognisable offence, as her child sustained grievous injuries in the alleged incident. In the present complaint, there was delay in registering the FIR against the culprit and for the reasons best known to the concerned officers, they woke up from their slumber after two months and registered an FIR in the matter, conducted investigation and filed a chargesheet against the accused before the competent court," said a Commission member.

Considering the background and lapse in registering the FIR promptly, which clearly amounted to breach of violation of Chavan, the Commissioner recommended compensation of Rs 25,000 to be paid to Chavan within four weeks from the date of receipt of the order, by the office of the Additional Chief Secretary (Home).
