The Palghar Legislatiev Assembly (ST) is set to have by-poll on February 13 this year. The counting would be held on February 16, said a highly placed official of the election commission.

The commission is set to officially announce the election dates on Wednesday. Congress leader Rajendra Gavit and late Krushna Ghoda's son Arjun Ghoda are expected to be main contenders in the election.

The seat had fallen vacant after the demise of Shiv Sena MLA Krushna Ghoda on May 24 following which the EC had inadvertently announced the by-poll on June 27.

The election code of conduct had also come into force. However, the election was cancelled after the EC was informed about an election petition related to Ghoda's nomination pending before the Bombay high court.

The petition was filed by the former Congress MLA Rajendra Gavit's son after declaration of the results of the assembly polls of October 2014. Gavit had lost to Ghoda by 515 votes and had challenged the assets declared by Ghoda in his affidavit.

The petition was disposed of in August 2015 on account of Ghoda's death. The EC had recently concluded an extensive voter deletion drive but had not touched the voter list of the Palghar constituency to avoid any unpleasant outcome in the by-poll.
