Now, Maharashtra Government makes filing of mortgage details a must

In order to prevent fraudulent practices like availing loans on the same property from multiple banks and selling it off to a third party, the department of stamps and registration has made it mandatory to register details of such mortgages with itself.

At present, notices of intimation can be filed or registration of mortgage deeds can be done at the sub-registrar offices. Now, the department is planning to start e-filing of notice of intimation on mortgages – here no document is created and just the sale deed is deposited with the bank.

Officials said though mortgages of title deeds are meant to avail short-term loans, they are also being used to get long-term credit. While nationalised banks insist on registration of mortgage deeds with the department, some small players chose not to do so.

“This will prevent frauds like same property being mortgaged further to other banks or sold to other people. E-filing of notice of intimation of mortgage will start soon,” said S Chockalingam, inspector general, Registration and Controller of Stamps.

People with access to web cameras and biometric devices and have Aadhar cards will soon be able to avail the e-filing facility.  While the mortgage document has to be registered with the sub-registrar in four months, a notice of intimation of creation of mortgage will have to be filed by the person taking loan within one month of creation of mortgage, listing details like property mortgaged and amount of mortgage.
