Now, Kala Ghoda Festival events at Cross Maidan

The Bombay High Court on Wednesday, allowed the Kala Ghoda Festival organisers to hold cultural programmes at Cross Maidan, until February 11, the last day of the festival.

A division bench of Justice Abhay Oka and Justice P N Deshmukh while allowing the programs, held that the City Collector had not applied his mind while granting the ‘No Objection Certificate’ and only after the court reprimanded him, that he levied a fee to the organisers, at the rate of commercial use of premises, which is in violation of the Supreme Court order.

The court has directed the organizers to submit an undertaking to the court, that no food stalls will be put up at the maidan, and no form of commercial activity will be carried out.

The court held that since the amount was undisputed in the organiser’s plea, they can go ahead with the program. 

The organisers had to move the court seeking permission as last year, the court had directed that all future  permissions for use of ground would be after prior permission from court.  The city collector on January 30 passed an order permitting the events to be held. However, the court took objection to it saying it was passed without “proper application of mind” and “without according proper reasons.”

Following which the Collector on February 6, passed a fresh order, without imposing conditions but levied a fee for use of the maidan.

Now the organisers have to pay a fee of over Rs 3 lakh to the Collector for use of the Cross maidan during the festival.

THE RIDERS 

  • The court directed the organizers to submit an undertaking that no food stalls will be put up at the maidan. The court held that since the organizers had not disputed the amount of fees in their plea can go ahead with the programme.
