A section of the Sikh community has written to the state government asking it to notify rules and regulations for registration of Sikh marriages as per Anand Marriage Act. The letter was written by the umbrella body of the Sikh community, Sri Guru Singh Sabha.
The letter to the chief minister states that the body "requests you to notify the rules and regulations for registration of Sikh marriages under the Anand Marriage Act for the state of Maharashtra which has a sizeable Sikh population."
The letter states that the Anand Marriage Act of 1909 was amended and adopted by the Parliament in June 2012 paving the way for registration of marriages of Sikh individuals under the Act. The central act requires states and union territories to frame rules and regulations for registration of marriages under the Act and notify them.
"Many states in India have notified this making it convenient for Sikhs to register their marriages under the said Act. Even the states of Meghalaya and Orissa wth a tiny Sikh population have done it. Delhi adopted it days ago. We hope that it is done here too," said Manmohan Singh, general secretary, Sri Guru Singh Sabha Mumbai.
"Since the rules are not notified, marriages are registered as Hindu marriages as of now. Sikhs are not able to register their marriages as Sikh marriages. We want the rules to be notified so that it can be done," said Singh.
"As of now, there is either provision of either Special Marriage Act wherein it does not matter or the Hindu Marriage Act in which marriages are registered. Sikhs are considered to be Hindus and part of the Hindu community," said Sajan Oommen, former president of the family court bar association. The chief minister did not respond to a SMS from DNA.
