No proof of attempt to culpable murder: Sessions court grants bail to dance bar owner

The Sessions court while granting bail to a 28-year-old man who was arrested for allegedly running a dance bar in Grant road said, nowhere it can be seen that the women who were rescued by the police, were tried to be murdered in any way. The court held that in order to prove the case of attempt to culpable homicide (308 IPC), it is important that there should be an intention of causing death, but it is not so in the case.

The court in its orders maintained that there was no intention to kill the two women who were seen dancing in the hotel. "The two women who were rescued from a closed room, went to the room on their own to hide themselves from getting caught," held the court in its orders.

The court also mentioned that apart from the section 308 of IPC, the other sections slapped against the man were bail able one's and were magistrate tri-able too.

According to the accused, he was arrested on July 27, 2018 as he is one of the licensees of the alleged dance bar where the raid was conducted. He said that he had nowhere dumped the two women in the room, but they themselves went. Also the place is been owned by a third party and that he has no role in the alleged offence. The accused also maintained that he was unable to understand why he was slapped with charge of attempt to commit culpable homicide.

The prosecution however opposed the plea on the grounds that the accused was very much a part of running the dance bar along with other people. The prosecution in an attempt to explain the application of section 308 IPC against the accused claimed that the room in which the women were found was so small and without ventilation that if the police failed to reach on time, the women would have died of suffocation.
